Tanks Violations
Facility Financial responsibility must be reported yearly - Per 41 Ill. Adm. Code 176.220, tank owners/operators must submit an electronic Financial Responsibility Report form on an annual basis. Financial Responsibility must be maintained until the tank is removed or properly abandoned in place by a licensed UST decommissioning contractor. The form can be found at: https://webapps.sfm.illinois.gov/USTPortal/Forms/FinancialResponsibility.
1, 2, 3, 4 Remove tank(s) - Single-Walled, Over 30 Years Old and OOS Over One Year - Single walled tanks (1, 3 & 4) were taken out of service on 11/14/24, and are 44 years old. Per 175.810(e) single wall USTs must be removed, as they are now condemned. Tank #2 was previously abandoned in place on 3/14/19. Per 175.840(e), it states "when a UST is allowed to be abandoned-in-place, the abandoned-in-place UST shall be removed when the condition for issuing the abandonment no longer exists. The reason for abandonment, was tank #4 was located in the same tank bed as tanks 1, 3 & 4. Therefore since these tanks have to be removed, tank #2 will have to be removed too. Here is a link to the licensed UST Decommissioning contractors, that can perform UST tank removals: https://webapps.sfm.illinois.gov/ustsearch/ContractorSearch.aspx
Facility Submit Notification Form For Ownership Change - Per 41 Ill. Adm. Code 176.440 (g), a change of ownership information must be reported on an electronic Notification for Underground Storage Tank form, within 30 days of the change. According to the Clay County Property Tax Portal, this property was sold to you on 9/25/24. The Notification Form is available at: https://webapps.sfm.illinois.gov/USTPortal/NotificationForm.
